Administrative investigations and disciplinary proceedings - EESC

Opinion of 9 November 2009 on the notification for prior checking regarding the EESC internal administrative investigations and disciplinary proceedings dossier (Case 2008-569)

On the basis of Article 2(3) of Annex IX to the Staff Regulations, General Implementing Provisions governing disciplinary procedures and administrative investigations were adopted by the European Economic and Social Committee on 7 December 2005.

The EDPS has formulated recommendations, in particular as regards data quality, time-limits for data storage (in relation specifically to the personal file but also to traffic data and hearings), rights of access and rectification and the confidentiality declaration to be provided to data subjects.

Evaluation of the President and the Vice-President - CPVO

Opinion of 28 July 2009 on a notification for prior checking concerning "Evaluation of the President and the Cice-President of the CPVO" (Cases 2009-355 and 2009-356)

The Community Plant Variety Office (CPVO) submitted to the EDPS two notifications for prior checking concerning annual appraisal, probationary period and management trial period of the President of the CPVO and of the Vice-President of the CPVO. Those appraisals are conducted by the reporting officers who are two members of the Administrative Council of the Office (AC) appointed by the AC.

The EDPS has examined the personal data processing involved in this processing and has concluded that it does not seem to entail any breach of the provisions of Regulation (EC) No 45/2001 provided that certain recommendations are followed, in particular that the service responsible should establish a shorter retention period for all paper and electronic files, remind all recipients of data of their obligation not to use the data received for any further purpose beyond the purposes stated in the relevant CPVO Decisions and provide appropriate information to the persons concerned.

Specific declarations of interest - EFSA

Opinion of 5 June 2009 on a notification for prior checking regarding the "Handling of annual and specific declarations of interest" (Case 2008-737)

The European Food Safety Authority (EFSA) pursues a policy of screening potential conflict of interests. To this end, different categories of data subjects are requested to submit an annual and/or specific declaration of interests. The standard forms for declaring interests request diverse pieces of information. Failing to meet this obligation can lead to further consequences regarding the concerned person.

After carefully examining the information describing the processing operation, the EDPS advises EFSA, among others, to reconsider the data retention period, to ensure the right of access and rectification also regarding the paper files, to display the data protection notice not only in the Guidance Document but also in the first letter communicating with the expert and to improve further its security policy.
