The EDPS has provided comments in relation to the Commission's intention to establish a European regulatory framework on eCall. One of its major components will consist in putting forward a proposal for a Regulation providing for the mandatory introduction of the in-vehicle part of the eCall service in new type-approved vehicles in Europe.

The EDPS particularly welcomes a harmonised European approach to eCall, which should contribute to setting consistent data protection standards for its deployment and use. However the EDPS underlines that the choice of a mandatory introduction of eCall will have to be properly justified in terms of data protection. Furthermore, appropriate guarantees will need to be set forth in the Regulation which take into account data protection principles, including clarifying the responsibilities of the different operators and adopting rules for the processing of eCall data by all actors of the eCall chain. Given the data protection implications of the envisaged Regulation, the EDPS and the Article 29 Working Party should be duly consulted on the proposal from the Commission for a Regulation on eCall.

There are different reasons why data protection provisions in the context of this proposal are relevant. First, the proposal foresees the processing of various data, which in certain cases, can be considered as personal data. Moreover, the proposal also foresees transfers of these data and exchanges of information, both between Member States and with the Commission or the Community Fisheries Control Agency. The EDPS also notes that the proposal foresees the use of aggregated data in certain circumstances. All these aspects require respecting the data protection legal framework.

The EDPS welcomes that reference to privacy and data protection is made within the current proposal. However, some amendments are needed in order to provide clear requirements, both for the Member States and for the Commission to address the data protection aspects of the system.

Accord commercial anti-contrefaçon (ACAC)

Avis sur les négociations en cours au sein de l’Union européenne pour un accord commercial anti-contrefaçon (ACAC)

The EDPS has adopted an opinion on current negotiations by the European Union of a multilateral Anti-Counterfeiting Trade Agreement (ACTA) aimed at strengthening the enforcement of intellectual property rights and to combat counterfeiting and piracy.

In the light of the information reported about ACTA, the EDPS has concerns about the potential incompatibility between envisaged measures and data protection requirements.

The EDPS makes a number of recommendations in view of providing guidance to the European Commission on the privacy and data protection related aspects that should be considered in the ACTA negotiations. He stresses in particular that:

  • the fight against piracy on the Internet should not include large scale monitoring of Internet users through the use of "three strikes Internet disconnection policies" or "graduated response" schemes;
  • other less intrusive means to fight piracy on the Internet must be investigated  or, at least, envisaged policies should be performed at a more limited scope, notably through targeted ad hoc monitoring;
  • appropriate safeguards must be applied to all international data transfers in the context of ACTA, which should take the form of binding agreements between EU senders and third country recipients;
  • a public and transparent dialogue must be established on ACTA.
