International Agreements

As data flows digitally across borders, it essential that the protection of fundamental rights is ensured.  In our role as advisor to the EU legislator, the EDPS continues to offer his expertise on EU proposals for international agreements, including in the areas of trade, law enforcement (for instance on PNR agreements with non-EU countries) and administrative cooperation. The EDPS recommendations aim to ensure that individuals in the EU do not forfeit their rights when their personal data is transferred outside of the EU.

EDPS Inventory 2012 of legislative consultations: a challenging year ahead for data protection in the EU

Here, the EDPS identifies issues of strategic importance that will form the cornerstones of his consultation work for 2012, while not neglecting the importance of other legislative procedures where data protection is concerned.

EDPS issues an opinion on the new EU-US Passenger Name Record agreement

The European Data Protection Supervisor (EDPS) adopted on Friday an opinion on the Commission's proposal for a new agreement between the EU and the US on the exchange of passengers' data (Passenger Name Record - PNR)*. The agreement obliges airline companies to send to the US Department of Homeland Security (DHS) data relating to all passengers flying between the EU and the US.

EU Passenger Name Record: proposed system fails to meet necessity requirement, says EDPS

On 25 March 2011, the European Data Protection Supervisor (EDPS) adopted an opinion on a new Commission's proposal to oblige airline carriers to provide EU Member States with personal data on passengers (Passenger Name Record - PNR) entering or departing from the EU for the purpose of fighting serious crime and terrorism. Such data may include, for example, home address, mobile phone number, frequent flyer information, email address and credit card information.

EU external strategy on Passenger Name Record: EDPS calls for stricter conditions for the use and transfer of passenger's personal data

Today, the European Data Protection Supervisor (EDPS) issued an opinion on the European Commission's communication on the transfer of Passenger Name Record (PNR) data to third countries (*). The Communication sets out the EU external strategy on PNR and puts forward the general principles, including a set of data protection standards, that any PNR agreement with a third country should be based on.
