General Data Protection Regulation

Following many years of intense political debate on data protection in the European Union, the General Data Protection Regulation (GDPR) will finally become law across the EU in May 2018 and is designed to be the cornerstone of data protection in Europe. It sets out directly applicable rules on the rights of data subjects, the duties of those organisations that demand the processing of personal data and those that do the processing (data controllers and processors), international data transfers and the powers of supervisory authorities.

Review of relationship between transparency and data protection more urgent after Court ruling on Bavarian Lager

The European Court of Justice has issued its ruling on the so-called "Bavarian Lager" case (*), a case that has been closely followed as a key case on the question on how best to reconcile the fundamental right to the protection of personal data with the fundamental right of public access to documents.

The Court of Justice clarified certain key concepts in the Data Protection Regulation (**) and interpreted the Access to Documents Regulation (***) with regard to the right to privacy and data protection.

Reform of EU Data Protection law: EDPS calls on the European Commission to be ambitious in its approach

Today, in a speech at the European Privacy and Data Protection Commissioners' Conference in Prague, the European Data Protection Supervisor (EDPS), Peter Hustinx, spoke strongly about the need to be proactive in the context of the unfolding debate on the future of the EU legal framework for data protection. The EDPS called on the European Commission to remain ambitious in updating the existing framework to avoid the risk of an increasing loss of relevance and effectiveness of data protection in a society that is ever more driven by technological change and globalisation.

EDPS welcomes Court of Justice's ruling strengthening independent position of data protection authorities

Today, the Court of Justice decided1 that data protection authorities in the German Länder which supervise the processing of personal data in the private sector are not acting with "complete independence" as required by the Data Protection Directive 95/46/EC.

On 30 April, in his sixth year of activity, the European Data Protection Supervisor (EDPS) received the 500th prior-check notification on a processing of personal data in the EU administration. EDPS Opinion on transatlantic information sharing for law enforcement purposes: progress is welcomed, but additional work is needed

On 10 November, the European Data Protection Supervisor (EDPS) adopted an opinion on the Final Report by the EU-US High Level Contact Group on information sharing and privacy and personal data protection, which was presented by the Presidency of the European Union (EU) in June 2008. EDPS reports on EU institutions and bodies' compliance with their data protection obligations

On 14 May, the European Data Protection Supervisor (EDPS) presented his general report measuring the implementation of Regulation (EC) 45/2001 on the protection of individuals with regard to the processing of personal data by the institutions and bodies of the Community.
