EDPS Seminar on the essence of the fundamental rights to privacy and data protection
On the 8th of November 2023, the European Data Protection Supervisor organises a seminar on “the essence of the fundamental rights to privacy and data protection” at the European Parliament in Brussels.
This seminar aims at providing an opportunity for meaningful exchanges amongst officials from European institutions, data protection authorities and academia on a crucial aspect pertaining to the fundamental rights to privacy and data protection.
More specifically, the seminar focuses on:
- the meaning of the ‘essence’ requirement in EU fundamental rights’ law in general, having regard to the relevant jurisprudence of the Court of Justice of the European Union, as well as of the European Court of Human Rights and of national courts;
- the meaning of the ‘essence’ requirement, in particular, as regards the right to the protection of personal data as fundamental right;
- the criteria to determine when a limitation of the right to privacy or data protection should be regarded as a breach of the ‘essence’ requirement.
In addition, Prof. Dr. Gloria González Fuster (VUB) will present a study on the essence of the fundamental right to personal data protection, which was carried out at the request of the EDPS.
