Rights of the Individual

One of the aims of the General Data Protection Regulation (GDPR) is to empower individuals and give them control over their personal data. The GDPR has a chapter on the rights of data subjects (individuals) which includes the right of access, the right to rectification, the right to erasure, the right to restrict processing, the right to data portability, the right to object and the right not to be subject to a decision based solely on automated processing.

2014 Annual Report - EU Data Protection Reform: a historic opportunity for Europe

2014 was a year of transition for the EDPS, marked by the delayed selection and appointment of a new Supervisor and Assistant Supervisor. Despite the resulting uncertainty, the EDPS under the calm authority and tireless efforts of Peter Hustinx, whose 10-year tenure as EDPS drew to a close in 2014, continued to make significant progress in mainstreaming data protection in EU policymaking.

Building on this legacy, the EDPS' priorities for 2015, as part of the five year strategy of the dynamic team of new Supervisors, is to help the EU to speak with one voice on data protection to uphold the rights and interests of the individual in our digitalised society. To this end, the adoption of the data protection reform will be a significant milestone for Europe and an important message to the rest of the world.

EU Data Protection Reform: the EDPS meets international civil liberties groups

On Wednesday 27 May 2015, the European Data Protection Supervisor (EDPS) and international citizens groups discussed the ongoing reform of EU data protection rules. As the EDPS prepares a fresh contribution to assist the EU co-legislator in their trilogue meetings on the reform, the meeting was a valuable occasion to better understand the concerns of citizens.

The EU as a beacon of respect for data protection and privacy

EDPS Guidelines on conflicts of interest: data protection strengthens good public administration

The European Data Protection Supervisor (EDPS) encourages EU institutions and bodies (EU institutions) to balance transparency in the interests of the public and the data protection rights of individuals when managing the declarations of the conflicts of interest of people working for them. Panel for Financial Irregularities - ECA

Opinion of 17 March 2014 on the notification for prior checking received from the Data Protection Officer of the European Court of Auditors concerning the ECA's Panel for Financial Irregularities (Case 2013-0846)

The Opinion regards the European Court of Auditors' Panel for Financial Irregularities ("PFI"), which is competent to examine any infringement by an official or other member of the ECA's staff of a provision of the Financial Regulation or of any rule relating to financial management or the audit of transactions. The EDPS noted with great regret that the processing operation had already been established, but highlighted that the recommendations made by the EDPS need to be adopted accordingly. These focus mainly on ensuring that data subjects concerned benefit from their rights by means of (i) a privacy statement containing all pieces of information required under Articles 11 and 12 of the Regulation and ensuring that every data subject receives the privacy statement when his/her personal data is first recorded or disclosed, (ii) a reference to the right of the person concerned to comment on the facts mentioned in the draft final report in the Rules of Procedure and (iii) rules to safeguard the rights of other data subjects to access and rectification under Articles 13 and 14 of the Regulation.
