Rights of the Individual

One of the aims of the General Data Protection Regulation (GDPR) is to empower individuals and give them control over their personal data. The GDPR has a chapter on the rights of data subjects (individuals) which includes the right of access, the right to rectification, the right to erasure, the right to restrict processing, the right to data portability, the right to object and the right not to be subject to a decision based solely on automated processing.

The Commission proposal for a Decision on serious cross-border threats to health aims to increase cooperation between Member States in dealing with communicable diseases and other cross-border threats to health. To this end, it envisages among others a widening of the existing Early Warning and Response System (EWRS) to include new types of health threats and the use of contact tracing.

The EDPS Opinion raises several points for clarification, the most important of which are:

  •  The concept of contact tracing should be defined more clearly and the main types and sources of data to be exchanged should be specified. Also, criteria for assessing the necessity of contact tracing in a given case should be established;
  •  The relationship between the EWRS and the proposed ad hoc surveillance should be clarified, as well as the role of the European Centre for Disease Prevention and Control (ECDC) in ad hoc surveillance;
  •  A more specific reference to data security requirements should be introduced.

EDPS applauds strengthening of the right to data protection in Europe, but still regrets the lack of comprehensiveness

Today, the European Data Protection Supervisor (EDPS) adopted his Opinion on the proposed package for a reform of the EU rules on data protection. This package was adopted by the Commission on 25 January 2012 and includes a Regulation with general rules on data protection and a Directive with specific data protection rules for the law enforcement sector.

Investigations conducted by the European Anti-Fraud Office (OLAF)

Opinion on the Proposal for a Regulation of the European Parliament and of the Council amending Regulation (EC) No 1073/1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) and repealing Regulation (EURATOM) No 1074/1999 (Case 2011-0029), OJ C 279/02, 23.09.2011, p.11

The EDPS has adopted an opinion on a proposal for a Regulation which is intended to modify the current rules concerning investigations conducted by OLAF. The stated aim of the proposal is to increase the efficiency, effectiveness and accountability of OLAF, while safeguarding its investigative independence.

The EDPS supports the objectives of the proposed amendments and, in this respect, welcomes the proposal. However, despite the overall positive impression, the EDPS considers that from the point of view of the protection of personal data, the proposal could be further improved without jeopardising the objectives that it pursues.

Therefore the EDPS makes a number of recommendations that should be addressed by the modification of the text, and most importantly:

  • the proposal should clearly mention the right to information of the different categories of data subjects, as well as the right of access and rectification in relation to all the phases of the investigations carried out by OLAF;
  • the proposal should clarify the relationship between the need for confidentiality of the investigations and the data protection regime applicable during the investigations;
  • the proposal should clarify the general data protection principles on the basis of which OLAF can transmit and receive information, including personal data, with other EU bodies and agencies, third countries and international organisations;
  • the provisions of the proposal should give the Director General the task of ensuring that a strategic and comprehensive overview of the different processing operations of OLAF is carried out, kept up to date and made transparent, or at least that the need for this should be explained in a recital.

European Data Protection Commissioners insist on the need for a comprehensive EU approach to data protection

On 5 April 2011, the European Data Protection Supervisor (EDPS) and the Chairman of the Article 29 Data Protection Working Party(*) hosted the annual Spring Conference of European Data Protection Commissioners in Brussels, involving data protection authorities from EU and non-EU Member States, as well as various authorities at EU level.

Data protection and transparency: EDPS updates guidance for good practice in the EU administration

On 24 March 2011, the European Data Protection Supervisor (EDPS) published a background paper on public access to documents containing personal data, to serve as guidance for EU institutions.

The paper explains the updated EDPS position on the matter following the ruling of the European Court of Justice in the Bavarian Lager case on the reconciliation of the fundamental rights to privacy and data protection with the fundamental right to public access to documents and transparency (*).
