      Evaluation shows that the Data Retention Directive does not meet privacy and data protection requirements, says EDPS

      Today, the European Data Protection Supervisor (EDPS) adopted an opinion on the European Commission's Evaluation Report on the Data Retention Directive (*). This much discussed Directive requires all providers of electronic communication services to store traffic and location data of the communications of all citizens, for possible use by the Member States for law enforcement purposes.

      EDPS opinion on EU Financial Regulation: EU budget needs clear rules on transparency, also to protect individuals' personal data

      EU Passenger Name Record: proposed system fails to meet necessity requirement, says EDPS

      On 25 March 2011, the European Data Protection Supervisor (EDPS) adopted an opinion on a new Commission's proposal to oblige airline carriers to provide EU Member States with personal data on passengers (Passenger Name Record - PNR) entering or departing from the EU for the purpose of fighting serious crime and terrorism. Such data may include, for example, home address, mobile phone number, frequent flyer information, email address and credit card information.

      EU external strategy on Passenger Name Record: EDPS calls for stricter conditions for the use and transfer of passenger's personal data

      Review of relationship between transparency and data protection more urgent after Court ruling on Bavarian Lager

      The European Court of Justice has issued its ruling on the so-called "Bavarian Lager" case (*), a case that has been closely followed as a key case on the question on how best to reconcile the fundamental right to the protection of personal data with the fundamental right of public access to documents.
