ePrivacy Directive

This 2002 ePrivacy Directive is an important legal instrument for privacy in the digital age, and more specifically the confidentiality of communications and the rules regarding tracking and monitoring. The entry into force of the General Data Protection Regulation requires the EU legislator to update this text and the European Commission published a proposal on 10 January 2017. This new text will have to tackle the rapidly evolving technological landscape, with issues such as confidentiality of machine-to-machine communication (Internet of Things) or the confidentiality of individuals’ communication on publicly accessible networks (such as public Wi-Fi).

The "moment of truth" for the Data Retention Directive: EDPS demands clear evidence of necessity

In a speech today at the European Commission conference in Brussels on "Taking on the Data Retention Directive", Peter Hustinx, the European Data Protection Supervisor (EDPS), strongly argued in favour of seizing the opportunity of the ongoing evaluation process to clearly demonstrate the necessity and justification for the Data Retention Directive.

2009 Annual Report - A year of major importance for the fundamental right to data protection

The report shows that 2009 was of major importance for the fundamental right to data protection.

This is due to a number of key developments: the entering into force of the Lisbon Treaty, ensuring a strong legal basis for comprehensive data protection in all areas of EU policy; the start of a public consultation on the future of the EU legal framework for data protection; and the adoption of a new five-year policy programme for the area of freedom, security and justice ("Stockholm Programme") with the emphasis on the importance of data protection in this area.

The EDPS has been highly involved in these fields and is determined to pursue this course in the near future.

EU-US new draft agreement on financial data transfers: EDPS calls for further data protection improvements

ePrivacy Directive close to enactment: improvements on security breach, cookies and enforcement, and more to come

Following last week's agreement on the EU telecoms reform, nothing stands in the way for the ePrivacy Directive to enter into force. The formalities required for formal adoption will be undertaken in the coming weeks. The revised ePrivacy Directive(*), as amended by the European Parliament and adopted by the Council must be implemented by the Member States within 18 months.

On 9 January, the European Data Protection Supervisor (EDPS) adopted an Opinion on the review of the Directive on Privacy and electronic communications, usually referred to as the ePrivacy Directive.
