Rôle joué par les délégués à la protection des données (DPD) pour garantir le respect effectif du règlement (CE) n° 45/2001.

In this paper, the EDPS underlines how compliance with the Regulation in the institutions and bodies must be ensured at different levels. The DPO has a key role to play and the paper examines his/her functions and gives guidance on how they can best perform these tasks in an independent manner.

The EDPS stresses that all institutions and bodies need to appoint a DPO. However, this appointment does not in itself imply automatic compliance with the Regulation. Other obligations such as that of notifying processing operations to the DPO and subsequent notification by the DPO of sensitive processing operations to the EDPS for prior checking must be complied with.
