Règlement (CE) n° 45/2001

Le règlement (CE) nº 45/2001 établit les obligations des institutions de l’UE lorsqu’elles traitent des données à caractère personnel telles que l’obligation pour chacune d’elles de désigner un délégué à la protection des données. Il s’agit également du règlement qui a établi le Contrôleur européen de la protection des données en tant qu’autorité indépendante de protection des données chargée de veiller à ce que le droit à la protection de la vie privée soit respecté par les institutions et organes européens et de conseiller le législateur de l’UE sur les sujets présentant des implications en matière de protection des données. Ce règlement est en cours de révision afin d’être mis en conformité avec le règlement général sur la protection des données. La Commission européenne a publié une proposition le 10 janvier 2017.

Le CEPD présente sa nouvelle brochure intitulée Façonner un avenir numérique plus sûr pour informer le public sur notre rôle, nos tâches et nos responsabilités en tant qu’autorité indépendante de protection des données de l’Union européenne. La brochure comprend également un aperçu de la stratégie du CEPD pour les années 2020-2024.

Nous publierons la présente brochure dans toutes les langues officielles de l'UE au fur et à mesure de leur disponibilité.

2018 Annual Report - a new era in data protection

2018 was a busy year for the EDPS and a pivotal year for data protection in general. Under new data protection rules, the rights of every individual living in the EU are now better protected than ever. Public awareness about the value of online privacy is at an all-time high.

The 2018 Annual Report provides an insight into all EDPS activities in 2018. Chief among these were our efforts to prepare for the new legislation. The General Data Protection Regulation (GDPR) became fully applicable across the EU on 25 May 2018 and new data protection rules for the EU institutions are also now in place. Working with the new European Data Protection Board (EDPB), the EDPS aims to ensure consistent protection of individuals’ rights, wherever they live in the EU.

Délégués à la protection des données

Rôle joué par les délégués à la protection des données (DPD) pour garantir le respect effectif du règlement (CE) n° 45/2001.

In this paper, the EDPS underlines how compliance with the Regulation in the institutions and bodies must be ensured at different levels. The DPO has a key role to play and the paper examines his/her functions and gives guidance on how they can best perform these tasks in an independent manner.

The EDPS stresses that all institutions and bodies need to appoint a DPO. However, this appointment does not in itself imply automatic compliance with the Regulation. Other obligations such as that of notifying processing operations to the DPO and subsequent notification by the DPO of sensitive processing operations to the EDPS for prior checking must be complied with.
