Nos avis portent principalement sur des propositions législatives et sont adressés au législateur de l'UE (le Parlement européen, le Conseil et la Commission européenne), dans le but de signaler les principales préoccupations en matière de protection des données ainsi que nos recommandations. 

Ces avis sont rendus en réponse aux demandes de la Commission, qui est légalement tenue de demander notre avis sur toute proposition législative ou projet d'actes d'exécution ou délégués, ainsi que sur les recommandations et propositions au Conseil dans le cadre d'accords internationaux conformément à l'article 42(1) du règlement (UE) 2018/1725 lorsqu'il y a un impact sur la protection des données personnelles. 

Nous émettons également des avis d'initiative dans le cadre de notre rôle de conseil sur toutes les questions relatives au traitement de données personnelles.

Avis sur la proposition de règlement relatif à l'accès du public aux documents du Parlement européen, du Conseil et de la Commission, JO C 2, 7.01.2009, p. 7

The Opinion reacts on the Commission's proposal aimed at reviewing the rules on public access to documents held by EU institutions. The Opinion focuses on an amended provision dealing with the relation between public access to documents and the protection of personal data. Although the EDPS welcomes the Commission's intention to clarify the delicate interaction between public access and data protection, he feels that the substance of the proposed amendment fails to provide the appropriate answer. He therefore proposes a different provision to stimulate discussions in Parliament and Council.

Statistiques européennes

Avis sur la proposition de règlement relatif aux statistiques européennes (COM(2007) 625 final), JO C 308, 3.12.2008, p. 1

On 20 May, the EDPS adopted an Opinion on a proposal for a Regulation of the European Parliament and of the Council on European Statistics.

The proposal aims to revise the existing basic legal framework governing the production of statistics at European level with a view to adapting it to the current reality and also to improving it to meet future developments and challenges.

The EDPS welcomes this Regulation which will give a firm and general legal basis to the development, production and dissemination of statistics at a European level. However, the EDPS makes several recommendations on the proposed text, for instance:

  • He stresses that the concept of anonymity should be clarified in order to avoid any uncertainty regarding the data which may be made available for public use;
  • He recommends that the proposed concept of 'statistical data subject' should be reconsidered in order to avoid confusion with data protection concepts;
  • He underlines that data protection requirements should be taken into consideration in the quality assessment of the Commission;
  • Finally, he expects to be consulted on the sectoral legislation which could be adopted on statistics by the Commission in order to implement this Regulation, once it has been adopted

Sécurité routière

Avis sur la proposition de directive facilitant l'application transfrontière de la législation dans le domaine de la sécurité routière, JO C 310, 5.12.2008, p. 1

The EDPS issued an opinion on the proposal for a Directive facilitating cross-border enforcement in the field of road safety.

The proposal aims at reducing fatalities, injuries and material damage resulting from traffic accidents. In this context, the proposal intends to establish a system to facilitate the cross-border enforcement of sanctions for specified road traffic offences.

In order to contribute to a non discriminatory and more effective enforcement towards traffic offenders, the proposal foresees the establishment of a system of cross-border exchange of information between Member States.

The EDPS considers that the proposal provides for sufficient justification for the establishment of the system for the cross-border exchange of information, and that it limits the quality of data to be collected and transferred adequately.

He also welcomes the redress procedure foreseen in the proposal and, in particular, the fact that access to personal data will be possible in the country of residence of the data subject.

The EDPS also made the following recommendations:

  • on the information of data subjects: the way data subjects will be informed of the fact they have specific rights of access to their data and possible correction of these data will depend on the format of the offence notification. It is therefore important that the proposal lists all information relevant for the data subject, in a language that he/she understands.
  • on the security of the system: the EDPS has noted that it is foreseen to make use of an already existing infrastructure to exchange the information. The EDPS has no objection to this objective as far as it limits financial or administrative burdens. He insists however on the fact that this should not lead to interoperability with other databanks. The EDPS welcomes the proposed limit on the possibilities of use of the data by Member States other that the one where the offence was committed.
