The Opinion reacts on the Commission's proposal aimed at reviewing the rules on public access to documents held by EU institutions. The Opinion focuses on an amended provision dealing with the relation between public access to documents and the protection of personal data. Although the EDPS welcomes the Commission's intention to clarify the delicate interaction between public access and data protection, he feels that the substance of the proposed amendment fails to provide the appropriate answer. He therefore proposes a different provision to stimulate discussions in Parliament and Council.
Durant sa troisième année d'activités, le CEPD a continué à s'investir dans l'implantation d'une culture avancée de la protection des données dans les institutions et organes européens. Depuis 2004, 150 contrôles préalabes de traitements à risques et 25 avis sur des propositions de législation ont été publiés. The aim of the proposal is to fulfil the requirement on the publication of information on beneficiaries of Community funds, as inserted into the Financial Regulation by Council Regulation (EC, Euratom) No 1995/2006 of 13 December 2006. To that end, Member States should ensure annual ex-post publication of the beneficiaries and the amount received per beneficiary under European Funds, which form part of the budget of the European Communities.
In the opinion, the EDPS supports the inclusion of the transparency principle and underlines that a proactive approach to the rights of the data subjectsshould be respected. Moreover, the EDPS suggests introducing a specific provision, which would help to comply with Article 12 of Regulation (EC) No 45/2001, as regards the need to inform data subjects about the processing of their personal data by auditing and investigating institutions and bodies.

One of the main points of the proposals is that they foresee the set-up and organisation of a central database common to all institutions and bodies, operated by the Commission, of candidates and tenderers under specific situations of exclusions in case of fraud and allow the exchange of the information contained in the database with authorities at different levels.
Although the EDPS agrees to the principle of a central database in the light of the foreseen purposes of data processing, he underlined that a proactive approach to the rights of the data subjectsshould be respected. Data subjects must be informed beforehand that these data might be made public, and it must be ensured that the data subject's right of access and right to object are respected. The need for a precise timeframe regarding the update of the information as well as an adequate security protection of the database.
The need for specific safeguards in the context of transfers of personal data from the central database and receiving personal data from third countries and international organisations.
