Nos avis portent principalement sur des propositions législatives et sont adressés au législateur de l'UE (le Parlement européen, le Conseil et la Commission européenne), dans le but de signaler les principales préoccupations en matière de protection des données ainsi que nos recommandations. 

Ces avis sont rendus en réponse aux demandes de la Commission, qui est légalement tenue de demander notre avis sur toute proposition législative ou projet d'actes d'exécution ou délégués, ainsi que sur les recommandations et propositions au Conseil dans le cadre d'accords internationaux conformément à l'article 42(1) du règlement (UE) 2018/1725 lorsqu'il y a un impact sur la protection des données personnelles. 

Nous émettons également des avis d'initiative dans le cadre de notre rôle de conseil sur toutes les questions relatives au traitement de données personnelles.

Bonne application des réglementations douanière et agricole

Avis sur la proposition de règlement modifiant le règlement (CE) no 515/97 relatif à l'assistance mutuelle entre les autorités administratives des États membres et à la collaboration entre celles-ci et la Commission en vue d'assurer la bonne application des réglementations douanière et agricole (COM(2006) 866 final), JO C 94, 28.04.2007, p. 3

This Proposal foresees the creation or updating of various systems containing personal data, the European Data Directory, Custom Information System (CIS) and Customs Files Identification Database (FIDE), in order to strengthen the cooperation between Member States and the Commission to avoid breaches to customs and agricultural legislation. In this Opinion, the EDPS suggests various amendments to the Proposal in order to ensure the Proposal's overall compatibility with the existing legal framework on data protection and the effective protection of individuals' personal data. Among others, the Opinion calls upon the Commission to carry out a proper assessment of the necessity of the European Data Directory, proposes some amendments to recognize the EDPS supervisory role regarding CIS and FIDE and puts forwards a coordinated approach to its supervision (including national authorities and the EDPS).

Office européen de police

Avis sur la proposition de décision du Conseil portant création de l'Office européen de police (Europol) (COM(2006) 817 final), JO C 255, 27.10.2007, p. 13

The objective of the proposal is not a major change in the mandate or the activities of Europol, but mainly to provide Europol with a new and more flexible legal basis. The proposal also contains substantive changes, so as to further improve Europol's functioning. It extends the mandate of Europol and it contains several new provisions, aiming to further facilitate the work of Europol, for instance on the exchange of data between Europol and other bodies of the EC/EU, like Olaf.. The proposal contains specific rules on data protection and data security, additional to the general legal framework on data protection for the third pillar that has not yet been adopted. Other changes will bring the position of Europol more in line with other bodies of the EU.
The EDPS-opinion suggests a number of improvements and concludes moreover that the Council Decision should not be adopted before the adoption by Council of a framework on data protection, guaranteeing an appropriate level of data protection.

Règlement financier

Avis sur des propositions modifiant le règlement financier applicable au budget général des Communautés européennes et ses modalités d'exécution (COM(2006) 213 final et SEC(2006) 866 final), JO C 94, 28.04.2007, p. 12

One of the main points of the proposals is that they foresee the set-up and organisation of a central database common to all institutions and bodies, operated by the Commission, of candidates and tenderers under specific situations of exclusions in case of fraud and allow the exchange of the information contained in the database with authorities at different levels.
Although the EDPS agrees to the principle of a central database in the light of the foreseen purposes of data processing, he underlined that a proactive approach to the rights of the data subjectsshould be respected. Data subjects must be informed beforehand that these data might be made public, and it must be ensured that the data subject's right of access and right to object are respected. Other concerns relate to: 
  • The need for a precise timeframe regarding the update of the information as well as an adequate security protection of the database.
  • The need for specific safeguards in the context of transfers of personal data from the central database and receiving personal data from third countries and international organisations.

Protection des données dans le troisième pilier

Deuxième avis sur la proposition de décision-cadre du Conseil relative à la protection des données à caractère personnel traitées dans le cadre de la coopération policière et judiciaire en matière pénale, JO C 91, 26.04.2007, p. 9

The second opinion on the proposal for a framework decision for data protection in the third pillar was issued for two reasons. Firstly, a framework decision on the protection of personal data in the third pillar is extremely important to the EDPS. Secondly, there are serious fears that the negotiations in Council will result in essential safeguards to the citizens being deleted or substantially weakened. Therefore, the EDPS recommends that Council allows for more time for the negotiations in order to achieve a result.that offers sufficient protection.

The main concern is that the proposal in its current state will lead to an artificial division in data files - between national data and data originating from another Member State. Not only will this lead to burdensome, complex and costly handling, but it will also lead to difficulties for citizens in exercising their rights. A number of other concerns are raised, relating to the lack of special safeguards on sensitive data; possibilities to exchange data with non-law enforcement authorities; the non-requirement of 'adequate protection' guarantees when exchanging data with third countries, etc.

Assistance administrative mutuelle

Avis concernant la proposition modifiée de règlement relatif à l'assistance administrative mutuelle aux fins de la protection des intérêts financiers de la Communauté contre la fraude et toute autre activité illégale, JO C 94, 28.04.2007, p. 1

The amended proposal sets forth communication and assistance procedures between the Commission and Member States in order to protect the Community financial interests.
The EDPS considers that the proposal on the whole maintains the level of protection of personal data contained in the EU data protection framework; Directive 95/46/EC and Regulation 45/2001.

Nevertheless, the EDPS notes that whether such standards of data protection will indeed be maintained depend on the specific content of implementing legislation for which the proposal creates a legal basis. Since implementing legislation will be crucial for the protection of personal data in this context, the EDPS particularly welcomes the obligation to consult him on the drafting of such implementing legislation.
