Interopérabilité

L’interopérabilité fait référence à la fonctionnalité des systèmes d’information pour échanger des données et permettre le partage des informations. Plusieurs grandes bases de données ont été mises en place au niveau de l’UE afin de traiter les questions liées à la migration, l’asile et la sécurité intérieure. Ces bases de données contiennent des informations sur les personnes. Des initiatives ont été prises afin de déterminer et d'élaborer le lieu et la façon dont ces systèmes pourraient communiquer entre eux et échanger des informations. Chacun de ces systèmes a été créé dans un but spécifique. Conformément aux grands principes de protection des données, l’interopérabilité ne peut donner lieu à l’accès à des données, ou à leur utilisation, au moyen d’un autre système d’information ou donner accès à plus de données que nécessaire.

"Stockholm Programme" - An Area of freedom, security and justice serving the citizen

The EDPS has adopted an opinion on the European Commission's Communication of 10 June 2009 entitled “An area of freedom, security and justice serving the citizen”. The Communication is the Commission's contribution to the discussions on the new EU programme for the next five years in the area of justice and home affairs, the so called Stockholm programme, which is due to be adopted by the European Council in December 2009.

The EDPS supports the attention that has been devoted in the Communication to the protection of fundamental rights, and in particular the protection of personal data, as one of the key issues of the future framework for EU action on the questions of citizenship, justice, security, asylum and immigration. He fully endorses the Commission's view that more emphasis should be given to data protection in the areas concerned, and calls for the European Council to follow the same approach when adopting the Stockholm multi-annual programme.

Taking the need for protection of fundamental rights as main angle of the analysis, the EDPS opinion focuses on the following issues:

  • need for a comprehensive data protection scheme: the EDPS fully supports the call for a comprehensive data protection scheme covering all areas of EU competence, regardless of the entry into force of the Lisbon Treaty;
  • data protection principles: the EDPS welcomes the intention of the Commission to reaffirm a number of basic principles of data protection. He emphasises the importance of the purpose limitation principle as a cornerstone of data protection law. Focus should also be given to the possibilities for improving the effectiveness of the application of data protection principles, in particular through instruments than can reinforce the responsibilities of the data controllers;
  • Opinion on the Communication from the Commission to the European Parliament and the Council on an Area of freedom, security and justice serving the citizen, OJ C 276, 17.11.2009, p. 8European information model: the EDPS notes the developments towards a European information model and an EU Information Management Strategy with great interest and underlines the attention that should be given in these projects to data protection elements, to be further elaborated in the Stockholm programme. The architecture for information exchange should be based on "privacy by design" and "Best Available Techniques".

Coordination des systèmes de sécurité sociale

Avis concernant la proposition de règlement fixant les modalités d'application du règlement (CE) no 883/2004 portant sur la coordination des systèmes de sécurité sociale(COM(2006) 16 final), JO C 91, 26.04.2007, p. 15

The proposal covers a vast range of areas in social security (pensions, benefits in respect of maternity, invalidity, unemployment, etc). It aims at modernising and simplifying the existing rules by strengthening cooperation and improving methods of data exchange between social security institutions of the different Member States.

 

The EDPS welcomed the proposal to the extent that it aims at favouring the free movement of citizens and improving the standard of living and conditions of employment of those moving within the Union. With a view to ensuring a high level of data protection, the EDPS recommends: paying utmost attention to basic data protection principles such as purpose limitation as well as proportionality in data processed, bodies authorised to process data and retention periods; ensuring that each proposed mechanism of processing and transmission of personal data is clearly based on specific legal grounds; providing the concerned persons with relevant information on the processing of their personal data.

Office européen de police

Avis sur la proposition de décision du Conseil portant création de l'Office européen de police (Europol) (COM(2006) 817 final), JO C 255, 27.10.2007, p. 13

The objective of the proposal is not a major change in the mandate or the activities of Europol, but mainly to provide Europol with a new and more flexible legal basis. The proposal also contains substantive changes, so as to further improve Europol's functioning. It extends the mandate of Europol and it contains several new provisions, aiming to further facilitate the work of Europol, for instance on the exchange of data between Europol and other bodies of the EC/EU, like Olaf.. The proposal contains specific rules on data protection and data security, additional to the general legal framework on data protection for the third pillar that has not yet been adopted. Other changes will bring the position of Europol more in line with other bodies of the EU.
The EDPS-opinion suggests a number of improvements and concludes moreover that the Council Decision should not be adopted before the adoption by Council of a framework on data protection, guaranteeing an appropriate level of data protection.

Laissez-passer

Avis sur le projet de règlement du Conseil portant fixation de la forme des laissez-passer délivrés aux membres et aux agents des institutions, JO C 313, 20.12.2006, p. 36

The opinion analyses the draft Council Regulation on the community laissez-passer (CLP) to be issued to members and staff of the institutions and used as a diplomatic passport in third countries. According to the Council, as the initial implementation dated back to 1967, current security standards for EU travel documents require changes to the CLP.
The EDPS supports the proposal - albeit with some reservations, especially concerning the use of biometric data and reiterates his preference for the use of fallback procedures during the enrolment phase. The EDPS opposes the possible creation of central databases containing all the biometric data contained in the CLP for lack of proportionality.

The EDPS also stresses that the interoperability of the system with third countries' systems must not breach the purpose limitation principle of the processing of data. Moreover, the opinion also addresses the question of access by third countries.
