Coopération policière

L’objectif de la coopération policière et judiciaire en matière pénale est de garantir un niveau élevé de sécurité pour les personnes dans l’UE en prévenant la criminalité et en luttant contre celle-ci.

La coopération intervient entre les forces de police nationales et les autorités judiciaires nationales, avec l’aide d’agences de l’UE telles qu’Eurojust, Europol et le réseau judiciaire européen le cas échéant. Cette coopération implique la collecte et l’échange d’informations sur les personnes.

Coopération transfrontière (Traité de Prüm)

Avis sur l'initiative de 15 Etats membres en vue de l'adoption de la décision du Conseil relative à l'approfondissement de la coopération transfrontière, notamment en vue de lutter contre le terrorisme et la criminalité transfrontière, JO C 169, 21.07.2007, p. 2

The EDPS presented his opinion on the initiative of 15 Member States to make the Treaty of Prüm applicable throughout the EU. The initiative aims to step up cross-border cooperation, particularly for combating terrorism and cross-border crime. The initiative deals with the exchange of biometric data (DNA and fingerprints) and requires member states to set up DNA databases.

Although data protection plays an important role in this Treaty, the provisions on data protection in this initiative are meant as specific ones, on top of a general framework for data protection, which has still not been adopted. Such a framework is needed to give the citizen enough protection, since this decision will make it much easier to exchange DNA and fingerprint data.

Since the Prüm Treaty has already entered into force in three member states, the 15 Member States that took the initiative intend to limit substantial modifications.. Therefore, the EDPS' suggestions mainly serve to improve the text without modifying the system of information exchange itself.

Office européen de police

Avis sur la proposition de décision du Conseil portant création de l'Office européen de police (Europol) (COM(2006) 817 final), JO C 255, 27.10.2007, p. 13

The objective of the proposal is not a major change in the mandate or the activities of Europol, but mainly to provide Europol with a new and more flexible legal basis. The proposal also contains substantive changes, so as to further improve Europol's functioning. It extends the mandate of Europol and it contains several new provisions, aiming to further facilitate the work of Europol, for instance on the exchange of data between Europol and other bodies of the EC/EU, like Olaf.. The proposal contains specific rules on data protection and data security, additional to the general legal framework on data protection for the third pillar that has not yet been adopted. Other changes will bring the position of Europol more in line with other bodies of the EU.
The EDPS-opinion suggests a number of improvements and concludes moreover that the Council Decision should not be adopted before the adoption by Council of a framework on data protection, guaranteeing an appropriate level of data protection.

Protection des données dans le troisième pilier

The second opinion on the proposal for a framework decision for data protection in the third pillar was issued for two reasons. Firstly, a framework decision on the protection of personal data in the third pillar is extremely important to the EDPS. Secondly, there are serious fears that the negotiations in Council will result in essential safeguards to the citizens being deleted or substantially weakened. Therefore, the EDPS recommends that Council allows for more time for the negotiations in order to achieve a result.that offers sufficient protection.

The main concern is that the proposal in its current state will lead to an artificial division in data files - between national data and data originating from another Member State. Not only will this lead to burdensome, complex and costly handling, but it will also lead to difficulties for citizens in exercising their rights. A number of other concerns are raised, relating to the lack of special safeguards on sensitive data; possibilities to exchange data with non-law enforcement authorities; the non-requirement of 'adequate protection' guarantees when exchanging data with third countries, etc.
